Deletion of the requirement that the licensee meet the minimum ratios of Canadian to non-Canadian programming on a per channel basis | |

The Commission approves the applications by the Partners of Canal Indigo to amend its conditions of licence pertaining to the minimum ratios of Canadian to non-Canadian programming on each of its pay-per-view television services by eliminating the requirement that the licensee meet the ratios on a per channel basis. |

Canal Indigo is the licensee of a national French-language pay-per-view television service and a national French-language pay-per-view television service distributed by direct-to-home satellite. Each service is currently subject to the following condition of licence: |

The amended condition of licence reads as follows: |

Canal Indigo considers that the proposed amendment better reflects the realities of pay-per-view scheduling in a digital environment focused on offering an overall service. It will continue to maintain the existing exhibition ratios of Canadian to non-Canadian feature films and events over each entire service, no matter how many digital channels are dedicated to the service. |

Except for the DTH pay-per-view national television service which is distributed only in the digital mode, during the transition to full digital deployment, Canal Indigo will continue to meet the minimum ratios of Canadian to non-Canadian programming on a per channel basis for the portion of the service distributed in the analog mode. |

The Commission acknowledges the intervention submitted by the Canadian Association of Film Distributors and Exporters and is satisfied with the licensee's response. |
