Increase in power for CJBB-FM |

1. |
The Commission approves the application to amend the broadcasting licence for the radio programming undertaking CJBB-FM Englehart, by increasing the effective radiated power from 17 watts to 1,600 watts. |

2. |
This amendment will change CJBB-FM's status from that of a low power, unprotected service to a regular Class "A" FM station. |

Background |

3. |
Englehart is located in the district of Timiskaming in northeastern Ontario. With a population of 1,726, the town is situated midway between Kirkland Lake (population 10,440) and New Liskeard (population 5,431). |

4. |
CJBB-FM is the only commercial radio station located in Englehart. |
|
Interventions |
|
|
5. |
In its evaluation of this application, the Commission has taken into account the 43 supporting interventions submitted by individuals and community groups in the Englehart area. The Commission has also considered the concerns expressed in the opposing intervention filed by Connelly Broadcasting Corporation, licensee of CJTT-FM New Liskeard and CJKL-FM Kirkland Lake. |

Connelly claimed that the proposed power increase would have a negative impact on its stations. It was particularly concerned that they might lose advertising revenues to CJBB-FM. |

The licensee responded that it only wishes to provide a better signal within its licensed service area. It also stated that most of its advertisers are small "Mom & Pop" businesses who cannot afford to advertise on the larger stations operated by Connelly. |

The Commission's findings |
|

The Commission defines the market area of an FM station to be the lesser of the 3 mV/m signal contour, or the central area of the community served by the station, as defined by the Bureau of Broadcast Measurement. |

Englehart falls outside the approved 3 mV/m contours of CJTT-FM and CJKL-FM. CJBB-FM's power increase will bring all of Englehart within the station's primary 3 mV/m contour. |

Furthermore, both New Liskeard and Kirkland Lake are located well outside CJBB-FM's proposed 0.5 mV/m coverage contour. Accordingly, CJBB-FM would not be able to deliver a signal of competitive quality into these markets. The Commission notes that CJBB-FM is not licensed to serve either New Liskeard or Kirkland Lake. |

Based on the foregoing, the Commission is satisfied that approval of the proposed licence amendment will improve reception within Englehart of the only commercial radio station licensed to serve that community. The Commission is also satisfied that the power increase will not unduly affect CJTT-FM or CJKL-FM. |

Other matters |
|
|
12. |
The Commission authorizes the licensee to operate the undertaking on the basis of the contours and particulars resulting from the above-mentioned change. |
|
13. |
The Department of Industry has advised that this application is conditionally technically acceptable, subject to determination that there will be no unacceptable interference with NAV/COM services. When the Department has certified that a broadcasting certificate has been or will be issued, the amendment approved in this decision will be valid (section 22(1) of the Broadcasting Act). |
