  Licence renewal for CKNW
  1. The Commission renews the broadcasting licence for CKNW New Westminster from 1 January 2000 to 31 August 2003, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to consider at an early date the licensee’s compliance with CKNW’s conditions of licence.
  2. By condition of licence, the licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986, in those periods of category 2 music:
 

- consisting exclusively of music composed before 1956, devote a weekly average of 2% or more of its musical selections from content category 2 broadcast during those periods to Canadian selections broadcast in their entirety;

 

- consisting of 90% or more but not exclusively, of music composed before 1956, devote a weekly average of 10% or more of its musical selections from content category 2 broadcast during those periods to Canadian selections broadcast in their entirety.

  3. For purposes of this condition the terms "broadcast week", "content category" and "musical selection" shall have the meaning set out in section 2 of the Radio Regulations, 1986.
  4. With regard to the above-noted condition of licence, whenever requested by the Commission to submit information concerning the station’s broadcasting of Canadian music, the licensee must ascertain the date of composition of the selections it broadcasts and it must identify the programming periods which include the broadcast of pre-1956 musical selections.
  5. Based on its analysis of CKNW’s program logs and tapes for the week of 15 to 21 February 1998, the Commission finds that the licensee has failed to comply with its condition of licence regarding music composed before 1956. The licensee explained that the non-compliance was a result of the broadcast of the Jack Cullen Show which offered programming that reflects the 20’s and 40’s. The licensee has since cancelled this program.
  6. The Commission reminds the licensee that it must comply with its conditions of licence at all times.
  Employment Equity
  7. The Commission notes that this licensee is subject to the Employment Equity Act that came into effect on 24 October 1996 (1996 EEA), and therefore files reports concerning employment equity with Human Resources Development Canada. As a result of a consequential amendment to the Broadcasting Act, the Commission no longer has the authority to apply its employment equity policy to any undertaking that is subject to the 1996 EEA.
