Telecom Order CRTC 98-1344

By letter dated 24 April 1998, Pacifictel Communications Inc. (Pacifictel) requested an exemption from contribution charges with respect to certain business lines used for administrative purposes. Pacifictel provided a list of these lines in the Toronto, Ajax and Oshawa exchanges.

1.By letter dated 21 May 1998, Bell Canada (Bell) noted that, pursuant to Telecom Order CRTC 96-74 dated 30 January 1996, Pacifictel previously received an administrative exemption with respect to certain business lines. Bell also noted that in Telecom Order CRTC 97-590 dated 1 May 1997, the Commission ruled that administrative circuits which are directly interconnected to a service provider's interexchange network should attract contribution charges after 1 January 1998. Bell assumed that the current application from Pacifictel seeks to extend its existing administrative exemption after 1 January 1998 on the basis that the lines are not directly interconnected to a service provider's interexchange network.

2.Bell noted that the number of lines appears reasonable. However, Bell submitted that approval of such exemptions should be subject to the requirement for the reseller to file an affidavit with the Commission and Bell affirming that the services are not directly connected to the reseller's interexchange network or the interexchange network of another service provider. In light of this, Bell agreed with the requested exemption, subject to Pacifictel filing this affidavit.

3.By fax dated 13 November 1998, Pacifictel submitted an affidavit dated 12 November 1998 which was deficient. By fax dated 30 November 1998, Pacifictel submitted a revised affidavit dated 30 November 1998.

4.The Commission considers that the revised affidavit dated 30 November 1998 meets the Commission's evidentiary requirements for administrative circuits.

5.In light of the above, Pacifictel's existing administrative exemption beyond 1 January 1998 is extended such that no contribution is payable.
