Telecom Order CRTC 96-74
|
IN THE MATTER of applications from resellers of Centrex III Service requesting exemptions from the contribution charges specified in Competition in the Provision of Public Long Distance Voice Telephone Services and Related Resale and Sharing Issues, Telecom Decision CRTC 92-12, 12 June 1992 (Decision 92-12).
|
WHEREAS the Commission notes that Bell Canada considers that these applications are acceptable;
|
WHEREAS the Commission is of the view that these applications meet the Commission's evidentiary requirements as set out in Decision 92-12 and Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993;
|
WHEREAS, in Telecom Order CRTC 95-481, 20 April 1995 (Order 95-481), the Commission considered an application by Rebel Communications (Rebel) for exemption from contribution for systems in five locations;
|
WHEREAS, in Order 95-481, the Commission granted exemption from contribution for the Brockville, Ontario system only stating that new affidavits would be required in relation to the remaining four systems in Toledo, Kingston and Winchester, Ontario and Knowlton, Quebec when they came into use;
|
WHEREAS the Commission has now received an application dated 21 April 1995, with an affidavit for Rebel's systems in Cornwall and Kingston, Ontario and Knowlton and Sherbrooke, Quebec;
|
WHEREAS Rebel requested retroactive exemption to 1 February 1995 for these systems;
|
WHEREAS the Commission notes that applications for exemption for the Cornwall, Ontario and Sherbrooke, Quebec systems were only dated 21 April 1995 and were not listed in the application leading to Order 95-481;
|
WHEREAS the Commission considers that, absent special circumstances, contribution exemptions should not generally be made back to the date of installation; and
|
WHEREAS the Commission considers that such special circumstances do not exist in respect of these two systems -

IT IS ORDERED THAT:

3. 839286 Ontario LTD (4 December 1994).

4. Niagara Satellite Communications (21 July 1995).

5. 739651 Ontario Limited (Telelink Canada) (8 September 1995).
|
6. Quadnet Communications Inc. (29 August 1995).

7. Rebel Communications:
|
a) for single-hop lines located in Kingston, Ontario and Knowlton, Quebec (1 February 1995); and
|
b) for single-hop lines located in Cornwall, Ontario and Sherbrooke, Quebec (21 April 1995).

8. TTN Teletalk Network (26 April 1995).
|
The following applications are approved effective the date of installation:

9. Kit Communication (19 December 1994).
|
10. Pacifictel Communications (30 August 1995) subject to receipt of a revised affidavit correcting 1994 to 1995.

11. Rebel Communications (7 July 1995) (administrative lines).
