REGULATION OF INSIDE WIRING IN TÉLÉBEC LTÉE'S SERVICE TERRITORY
|
|
1. The Commission has received an application for forbearance from regulation of the installation, maintenance and repair of inside wiring, pursuant to section 34 of the Telecommunications Act (the Act) by Télébec ltée (Télébec). Télébec has requested forbearance from sections 24, 25, 27, 29, and 31 of the Act.

Background
|
|
2. In Télébec ltée - Development Plan for 1995-1999, and Revenue Requirement for 1995, Telecom Decision CRTC 94-26, 29 November 1994, (Decision 94-26), the Commission transferred to subscribers the responsibility for installing and maintaining inside wire and denied an inside wiring insurance plan proposed by Télébec.

3. The Commission has approved tariffs for inside wire work as proposed by Télébec. Télébec claims that the currently approved rates cause the company to lose market share.
|
|
4. The Commission recently issued New Regulatory Framework for Broadcasting Distribution Undertakings, Public Notice CRTC 1997-25, 11 March 1997 (Public Notice 1997-25), and Proposed Broadcasting Distribution Regulations, Public Notice CRTC 1997-84, 2 July 1997 (Public Notice 1997-84).

Issues
|
|
5. The Commission invites comments on issues relating to the forbearance from regulation of Télébec's services relating to the installation, maintenance and repair to inside wiring. In addition to any general comments, parties are also asked to address the following issues:
|
|
(1) whether the market for inside wire services is sufficiently competitive for the Commission to forbear from regulation of these services;
|
|
(2) the allocation of inside wiring revenues and expenses to the appropriate Phase III Broad Service Category if the Commission were to forbear from the regulation of inside wiring services of the company;
|
|
(3) whether, with forbearance, subscribers would continue to be responsible for inside wire, and whether Télébec should be allowed to offer maintenance and insurance plans for inside wiring;
|
|
(4) whether Télébec's authorization would be required for a subscriber to use inside wire for services not provided by Télébec;
|
|
(5) whether forbearance should be limited to twisted copper wire installations, or whether forbearance should also extend to any other inside wiring system that Télébec may wish to deploy;
|
|
(6) whether, if forbearance is appropriate, any conditions should be imposed that would continue to apply to Télébec; and
|
|
(7) whether the Commission should have regard to its proposals for the treatment of inside wire in Public Notices 1997-25 and 1997-84 when considering this application.

6. The Commission has issued interrogatories to Télébec, requesting that responses be filed by 15 October 1997.

8. Télébec is made a party to this proceeding.

9.
