Telecom Order CRTC 97-94
IN THE MATTER OF an application by The New Brunswick Telephone Company, Limited (NBTel) under Tariff Notice 581 (TN 581) dated 16 October 1996, proposing revisions to the company's Cellular Access Service tariff for the provision of trunk-side access and Common Channel Signalling #7 (CCS7) to Cellular Service Operators (CSOs).
WHEREAS NBTel stated that its application provides for an interim arrangement in advance of a final determination regarding Telecom Public Notice CRTC 95-36, 11 July 1995 Implementation of Regulatory Framework - Local Interconnection and Network Component Unbundling (PN 95-36);
WHEREAS Telecom Order CRTC 96-687 dated 28 June 1996 (Order 96-687) established an interim regime for the interconnection of Wireless Service Operator's public mobile radio service with Bell Canada's public switched telephone network pending resolution of matters under consideration in PN 95-36;
WHEREAS Order 96-687 provided for a tandeming feature, among others, on a trunk-side connection basis where facilities permitted;
WHEREAS comments were received from Clearnet Communications Inc. (Clearnet) and Rogers Cantel Inc. (Cantel);
WHEREAS NBTel filed reply comments;
WHEREAS Clearnet and Cantel commented that NBTel restricted its tariff to CSOs and that it should be made available to Personal Communication Services (PCS) providers and Service Operators providing Specialized Mobile Radio/Enhanced Specialized Mobile Radio (SMR/ESMR);
WHEREAS NBTel replied that it restricted its tariff revision to CSOs because no other type of Wireless Service Operator had applied for interconnection;
WHEREAS Cantel noted that the Commission had not disposed of Tariff Notices 472 and 519 relating to NBTel's Cellular Access Service tariff;
WHEREAS Telecom Order CRTC 96-1393 dated 3 December 1996, disposed of NBTel's Tariff Notices 472 and 519;
WHEREAS NBTel, in its reply comments, sought approval to withdraw TN 581; and
WHEREAS Cantel replied arguing against withdrawing TN 581 -
