Telecom Order CRTC 97-79
|
IN THE MATTER OF an application by TELUS Communications Inc. (TCI) under Tariff Notice 820 (TN 820) dated 30 August 1996, proposing revisions to the company's Cellular Access tariff for the provision of trunk-side access and Common Channel Signalling #7 (CCS7) to Cellular Service Operators and extending the tariff to Personal Communications Service (PCS) providers.

WHEREAS the Commission granted TN 820 interim approval in Telecom Order CRTC 96-1064 dated 27 September 1996;
|
WHEREAS TCI stated that its application was consistent with the directives set out in Telecom Order CRTC 96-687 (Order 96-687) dated 28 June 1996;
|
WHEREAS Order 96-687 established an interim regime for the interconnection of the public mobile radio service of a Wireless Service Operator (WSO) with Bell Canada's public switched telephone network pending resolution of matters under consideration in Implementation of Regulatory Framework - Local Interconnection and Network Component Unbundling,Telecom Public Notice CRTC 95-36, 11 July 1995, (PN 95-36);

WHEREAS Order 96-687 provided for tandeming and transiting on a trunk-side connection basis;
|
WHEREAS comments were received from Clearnet Communications Inc. (Clearnet), Microcell Telecommunications Inc. (Microcell), Rogers Cantel Inc. (Cantel) and the Canadian Wireless Telecommunications Association (CWTA);
|
WHEREAS TCI filed reply comments;
|
WHEREAS TCI stated in its tariff (Item 315.3 15.) that local tandem functionality is not available;
|
WHEREAS Cantel, Clearnet, CWTA and Microcell objected to the absence of tandem and transiting functionality;
|
WHEREAS TCI replied that it currently does not have local tandem functionality in any of its local switches because the company has not deployed local tandem operation within its own local network;
|
WHEREAS Clearnet asked the Commission to direct TCI to augment this tariff item to also accommodate Specialized Mobile Radio/Enhanced Specialized Mobile Radio (SMR/ESMR) service providers;
|
WHEREAS Cantel proposed that TCI be directed to continue to perform telephone number administration;
|
WHEREAS TCI replied that for the interim arrangement proposed in TN 820, the company would be prepared to continue to perform telephone number administration;
|
WHEREAS the Commission notes that the proposed revisions do not change TCI's current telephone number administration responsibilities;
|
WHEREAS Cantel, Clearnet and CWTA questioned the application of a link charge for trunk-side interconnection;
|
WHEREAS TCI replied that as the application of a link charge is based on the existing TCI cellular access tariff for a line-side connection and is still required for trunk-side connection, the application of a link charge for trunk-side connection is appropriate;
|
WHEREAS Clearnet, CWTA and Cantel objected to the requirement to connect to TCI's gateway STP for CCS7 signalling if they interconnected to TCI's local switches on a trunk-side basis;
|
WHEREAS TCI replied that because the trunk-side connection proposed in this tariff is for local service, the CCS7 interconnection must be made in TCI's territory; and
|
WHEREAS the Commission notes that the CCS7 interconnection requirements for local competitors are also under review in the local competition proceeding -

IT IS HEREBY ORDERED THAT:
|
1. TCI is directed to file proposed tariff pages for interim approval within 30 days that:
|
(a) allow for local tandem trunk-side connection as well as transiting of traffic. The associated rate element is to allow for the recovery of any one-time incremental cost, such as software and associated processor costs, to convert the switch to the tandem functionality;
|
(b) clarify that, in this interim regime, Items 6) (a) and (b), CCS7 links to the TCI Stentor gateway STP, are optional to those WSO's who wish to connect at the TCI gateway STP; and
|
(c) extend the availability of this tariff to SMR/ESMR service providers.
|
2. The existing Cellular Access Service tariff is hereby made interim, effective the date of this Order, pending the resolution of matters under consideration in PN 95-36.
