IN THE MATTER OF an application filed by TELUS Communications Inc. (TCI) under Tariff Notice 862 (TN 862) dated 2 December 1996, for proposed revisions to the company's General Tariff which reflect the local rate plan portion of the company's rate rebalancing plans for 1997, filed pursuant to Telecom Decision CRTC 95-21 dated 31 October 1995 (Decision 95-21).
WHEREAS by Telecom Order CRTC 96-1593 dated 23 December 1996, the Commission granted interim approval to TN 862 but denied the proposed $2.00 per month local rate increase for certain Centrex Service rates;
WHEREAS by letter dated 20 December 1996, AT&T Canada Long Distance Services Company (AT&T Canada) submitted that Centrex Service rates should be increased by $2.00 per month since they are not compensatory;
WHEREAS TCI replied by letter dated 13 January 1997;
WHEREAS Decision 95-21 required that rate rebalancing apply to all non-compensatory primary exchange services;
WHEREAS Centrex Service is defined in the TCI Competitive Terminal Services Tariff as a combination of basic exchange and intercommunicating services; and
WHEREAS in the light of the definition of Centrex service in the TCI tariff, the Commission considers that Decision 95-21 does not apply to TCI's Centrex Service -
IT IS HEREBY ORDERED THAT:
1. Subject to 2 below, TN 862 is approved on a final basis effective 1 January 1997.
2. The proposed $2.00 per month local rate increase for certain Centrex Service rates is denied.
