IN THE MATTER OF an application filed by TELUS Communications Inc. (TCI) under Tariff Notice 862 (TN 862) dated 2 December 1996, for proposed revisions to the company's General Tariff which reflect the local rate plan portion of the company's rate rebalancing plans for 1997, filed pursuant to Telecom Decision CRTC 95-21.
WHEREAS, in TN 862, TCI proposed to increase Centrex rates, but proposed that customers with a contract having an effective date prior to 1 January 1997 would not be subject to an increase until such time as their contracts are renewed;
WHEREAS the Commission considers that the proposal by TCI with respect to Centrex rates could result in customers with similar Centrex commitments being charged different rates; and
WHEREAS the Commission considers that charging different rates to two different customers for the provision of Centrex service under the same terms and conditions based solely on the time of signing the Centrex contract would result in unjust discrimination and undue preference -
IT IS HEREBY ORDERED THAT:
1. Subject to 2 below, TN 862 is approved on an interim basis.
2. The proposed $2.00 per month local rate increase for certain Centrex Service rates is denied.
