The joint sponsors noted above have been given the opportunity to amend the request. Similarly, parties who had already submitted comments related to this request, further to Public Notice CRTC 1997-17, may amend or withdraw them and, if so, must advise the Commission and the joint sponsors before the 22 January 1998 deadline date for this hearing. Other interested parties may also submit new comments concerning this request on or before the deadline of 22 January 1998.

The application proposes that the licensees' current authorizations to distribute the U.S. commercial networks and/or PBS signals currently received either by terrestrial means or from Canadian Satellite Communications Inc. (Cancom) be retained.

There will be no net increase in the number of U.S. commercial networks and/or PBS signals currently distributed, except in the cases noted in Public Notice CRTC 1997-74 dated 2 June 1997.

The interventions related to this request which have been submitted further to the release of Public Notice CRTC 1997-74 dated 2 June 1997, are now part of the public file and will be placed on the agenda for this public hearing.

PROPOSED FEE

The applicant proposes to charge a basic monthly fee of $32.95 for the distribution of these services. For undertakings with less than 6,000 subscribers, the basic monthly fee is not regulated pursuant to the Cable Television Regulations, 1986.

The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that acceptable technical documentation has been filed with the Department.

 Transitional Digital Radio Undertakings

The Commission hereby announces that it has received applications for licences to carry on Transitional Digital Radio Undertakings associated with existing AM and FM stations. The following broadcasters plan to build Digital Audio Broadcasting (DAB) facilities at the CN Tower to simulcast their current programming services and, as many as 14 hours per week of new programming, using the EUREKA-147 DAB system in the frequency band 1452 MHz - 1492 MHz (L-Band). The purpose of the broadcasts is to introduce the public to this new radio service, as well as to refine coverage and market issues related to this new technology. The Commission intends to require Transitional Digital Radio Undertakings to adhere, by condition of licence, to Parts 1 and 1.1 of the Radio Regulations, 1986.

Application (199716338) by TQS INC., on behalf of the Partners of Canal Indigo, a general partnership (Canal Indigo) to acquire the 20% interest in Canal Indigo, a programming undertaking operating a pay-per-view television service distributed by direct-to-home satellite as well as other means of distribution. This 20% interest is presently owned by 2151065 Canada Inc., formerly known as Réseau de Télévision Quatre Saisons Inc. (RTQS).

This application is pursuant to Decision CRTC 97-483 dated 22 August 1997, wherein the Commission approved the transfer of TQS Inc. to a consortium controlled by Québecor Inc. and also approved, on an interim basis, the alternative application by Vidéotron Ltée to transfer the effective control of RTQS to Vidéotron Ltée, subject to an understanding that an application for the sale of RTQS or the interest in Canal Indigo by a third party be filed within 3 months of the said Decision.
