CHUM Limited
Licence amendments for CIDR-FM and CIMX-FM
1. Following Public Notice CRTC 1997-126 dated 8 October 1997, the Commission approves the applications by CHUM Limited to amend the broadcasting licences for CIDR-FM and CIMX-FM Windsor by deleting the condition of each licence requiring that the stations not be operated in the Specialty format, as defined in Public Notice CRTC 1995-60, or as amended from time to time by the Commission.
2. Currently, the two stations have the flexibility to adjust popular music mixes and change popular music-based formats, but are prevented by the condition of licence noted above from operating in the Specialty format. Programming based on jazz, classical music, news, talk, or a mix of various music styles would operate in the Specialty format. Approval of these applications will have the result that both CIMX-FM and CIDR-FM will be allowed to move from any type of programming to another, without application to the Commission.
3. In requesting this flexibility, the licensee noted that in the extremely competitive Windsor/Detroit radio environment, format changes are frequent and sudden, requiring flexibility and swift reaction from broadcasters to fill available and potentially profitable programming niches.
4. An intervention to these applications was submitted by Mr. Victor Lehan of Leamington, Ontario, expressing his concern with the American orientation of the programming broadcast on CIDR-FM and CIMX-FM. The Commission notes the licensee's response to the intervener, and reminds the licensee that, in Decision CRTC 93-490 dated 23 August 1993, the Commission stated that it considered the radio market in Windsor to be unique, in that one licensee operates all four local commercial radio stations, and reiterated its view that stations operating in such a broadcasting environment must reflect a firm Canadian orientation in news and spoken word programming.
5. In approving these amendments, the Commission notes that, due to the ownership situation of CHUM Limited, there are no other local broadcasters that could be affected by format changes on CIMX-FM and CIDR-FM.
6. In addition, the Commission reiterates its long-standing practice, noted above, of considering Windsor to be a unique market, requiring programming flexibility not required in other Canadian cities, in view of the numerous strong American radio signals received in Windsor, from stations competing in one of the largest American radio markets.
This decision is to be appended to each licence.
