Decision

Ottawa, 24 September 1997
Decision CRTC 97-553
Fundy Cable Ltd./Ltée
- 199703525
Addition of WUHF-TV
1. Following Public Notice CRTC 1997-87 dated 7 July 1997, the Commission approves, by condition of licence, the licensee's request for authority to distribute, at its option, the programming service of WUHF-TV (FOX) Rochester, New York, as part of the basic service of the undertakings serving the above-noted localities. The licensee is authorized to receive this signal over the air, or from any licensed or exempted Canadian broadcasting distribution undertaking authorized to provide signals to other broadcasting distribution undertakings.
2. The Commission notes that the applicant plans to receive the WUHF-TV (FOX) service via satellite.
3. This approval is consistent with Public Notice CRTC 1997-25 dated 11 March 1997 entitled New Regulatory Framework for Broadcasting Distribution Undertakings wherein the Commission stated that it would permit all distributors to carry a "4 + 1" package of U.S. network signals as part of the basic service but that it would continue its case-by-case public processes for applications proposing such distribution changes, so that interveners may make their position known. The Commission notes that no interventions were received in this instance.
This decision is to be appended to the licence.
