Substitution of other Canadian programming during sports blackouts
1. Following Public Notice CRTC 1997-61 dated 16 May 1997, the Commission approves the application submitted by Niagara Television Limited (Niagara) to amend the licence for CHCH-TV Hamilton, by adding a condition of licence authorizing the licensee to substitute other Canadian programming on its transmitter CHCH-TV-1 Ottawa in instances where sports telecasts of live hockey games of the Toronto Maple Leafs are subject to the blackout provisions specified in the rights agreement between Niagara, the National Hockey League and the team, provided that only Canadian programming be used in replacement and that the Canadian programming not be local. This amendment is applicable only for the substitution of other Canadian programming for live hockey games of the Toronto Maple Leafs, and only for the term of the current agreement between Niagara and the team, and any renewal or extension thereof which might occur during the remainder of CHCH-TV's licence term.
2. The Commission acknowledges the intervention received from CHUM Limited expressing concern that approval of Niagara's request would allow it to broadcast local programming on CHCH-TV-1 and thereby to compete for local advertising with other stations in the Ottawa market. The Commission notes that in its reply to the intervention, Niagara has indicated that the Canadian programming to be substituted will not be locally produced and that it stood by its commitment not to solicit advertising in the Ottawa-Hull market. The Commission is satisfied with the licensee's reply to the intervention.
This decision is to be appended to the licence.
