Addition of CITV-TV and CITY-TV
Following Public Notice CRTC 1996-160 dated 23 December 1996, the Commission approves the application for authority to distribute CITV-TV (IND) Edmonton and CITY-TV (IND) Toronto, on a discretionary tier of the cable distribution undertaking serving Dauphin.
In approving this application, the Commission has determined that the distribution of these signals falls within the guidelines on the cable distribution of distant Canadian television signals set out in Public Notice CRTC 1993-74.
CanWest Global System (CanWest), on behalf of CKND-TV Winnipeg, submitted an intervention opposing this application. According to CanWest, "CITV-TV expansion into Dauphin would extend the station's signal into a market for which CITV-TV does not own program rights for a substantial portion of its programming". As well, CanWest submitted that approval of this application would result in erosion of audience levels and cause serious undue economic harm to CKND-TV.
In response, the applicant stated that it had "confirmation from CITV-TV and CITY-TV that they will not accept any local advertising from the Dauphin market and that they will secure program rights where required to".
The Commission has reviewed the intervener's arguments, as well as the applicant's response thereto. Based on the evidence available to it, the Commission is satisfied that the distribution of CITY-TV and CITV-TV in Dauphin would have minimal impact on CKND-TV and its ability to meet its programming commitments.
On 14 March 1996, the Commission issued Public Notice CRTC 1996-36 outlining its policy on violence in television programming. In this policy statement, the Commission encouraged programming undertakings whose signals are distributed over various time zones to be sensitive to viewers in western time zones when scheduling programs.
The Commission notes that there is a one-hour time difference between Toronto and Manitoba. This means that programs with scenes of violence intended for adults that are broadcast on CITY-TV after the "watershed" hour of 9:00 p.m., as required by the Canadian Association of Broadcasters' "Voluntary Code Regarding Violence in Television Programming", could be distributed on the Dauphin undertaking before 9:00 p.m.
Accordingly, the Commission expects CITY-TV to be sensitive to the one-hour time difference between Toronto and Manitoba in scheduling programs containing scenes of violence intended for adults.
This decision is to be appended to the licence.
