RECONSIDERATION OF DECISIONS RELATED TO CANADIAN TALENT DEVELOPMENT BY COMMERCIAL RADIO STATIONS
In Order in Council P.C. 1996-1734 dated 14 November 1996 (the Order), the Governor In Council referred back to the Commission, for reconsideration and hearing, a number of decisions which are listed in the Appendix to this document.
These decisions included the following condition of licence:
 The licensee is required, by condition of licence, to make payments to third parties involved in Canadian talent development at the level identified for it in the Canadian Association of Broadcasters' (CAB) "Distribution Guidelines For Canadian Talent Development", as set out in Public Notice CRTC 1995-196 or as amended from time to time and approved by the Commission, and to report the names of the third parties associated with Canadian talent development, together with the payments paid to each, on its annual return. The payments required under this condition of licence are over and above any outstanding commitments to Canadian talent development offered as benefits in an application to acquire the ownership or control of the undertaking.
In addition, commitments by certain broadcasters to make specific payments to MusicAction were imposed as conditions of licence.
Applications by stations to adhere to the CAB Distribution Guidelines for Canadian Talent Development were first issued for public comment in Public Notice CRTC 1996-63.
The Order states that:
 The Governor in Council is of the opinion that it is material to the reconsideration and hearing that the Commission fully assess the issue of whether, in the case of commitments made by radio station licensees to FACTOR and MusicAction, the CRTC should treat FACTOR and MusicAction equitably regarding guarantees for long-term financing.
All interested parties are invited to submit written comments on the matter raised in the Order In Council; that is, whether FACTOR and MusicAction should be treated equitably regarding guarantees for long-term financing, no later than 31 January 1997.
Licensees affected by the decisions set out in the Order may file written comments on the matter set out above, as well as a written reply to any comments received by the Commission during this proceeding. Such comments should be filed with the Commission and a copy served to the intervenor by 21 February 1997.
