APPLICATIONS FOR AMENDMENTS BY LICENSEES OF COMMERCIAL RADIO PROGRAMMING UNDERTAKINGS WITH RESPECT TO CANADIAN TALENT DEVELOPMENT

In Public Notice CRTC 1995-196 the Commission set out a new approach to contributions by commercial AM and FM radio stations to Canadian talent development.

In that notice, the licensee of each commercial radio station was given an opportunity to apply for relief from current direct cost commitments for Canadian talent development made as part of its last licence renewal, and to amend its licence by adding a condition of licence requiring it to make payments to eligible third parties involved in Canadian talent development at the level identified for it in the CAB Distribution Guidelines For Canadian Talent Development. Such eligible third parties include FACTOR, MusicAction, national and provincial music organizations, performing arts groups, schools and scholarship recipients.

The guidelines, which were developed by the Canadian Association of Broadcasters (CAB), set out a distribution schedule for Canadian talent development funds based on a market-by-market approach in which a common fee schedule would be set for stations in similar markets. The purpose of the CAB's guidelines is to ensure that Canadian radio stations allocate a minimum of $1.8 million each year to eligible third parties associated with Canadian talent development. The CAB plan, however, applies only to commitments for Canadian talent development made in the context of licence renewals.

In the case of new licences, including situations where stations have moved from the AM to the FM band, licensees will be expected, for the duration of their first licence term, to adhere to existing Canadian talent development commitments. Licensees will also be expected to adhere to those commitments proposed as benefits in applications for authority to transfer the ownership or control of radio stations.

Pursuant to Public Notice CRTC 1995-196, the Commission has received applications which, taken together, achieve the objective of ensuring that a minimum of $1.8 million dollars is raised for third parties associated with Canadian talent development. Included among these are applications by certain major radio broadcasters, which have also pledged amounts over and above those set out in the CAB Distribution Guidelines in order to ensure that the minimum target of $1.8 million is met. These additional commitments will also be applied as conditions of licence should the applications be approved. Stations with these additional commitments have been marked with an asterisk in the list that is appended.

Other stations who have proposed payments to third parties at levels that are different than those set out in the CAB Distribution Guidelines are marked with a plus sign.

Furthermore the Commission has received letters guaranteeing that, during the first year, over $1 million will be allocated to FACTOR and MusicAction by stations participating in the CAB plan. This would include $721,272 to FACTOR and $287,200 to MusicAction.

The following is a list of the individual applications that have been received in response to Public Notice CRTC 1995-196 to replace the licensee's current commit- ments for Canadian talent development with new commitments based on the amounts outlined in that Public Notice, which would become conditions of licence.

-  your intervention should clearly identify the application and indicate whether you support or oppose the application, or if you propose changes to it, with facts and grounds therefor. In the event that the application is brought to the oral phase of a hearing it would be helpful to the Commission if you would provide reasons why your written comments are not sufficient and an appearance is necessary;

Your intervention will be considered by the Commission, and will form part of the public record of the proceeding without further notification to you, provided the procedure set out above has been followed. You will be contacted only if your submission raises procedural questions.
