Telecom Order CRTC 96-1076

IN THE MATTER OF an application by City Telecom Inc. (City Telecom) dated 8 April 1996, for contribution exemption for certain Canada/USA circuits used for transit traffic.

WHEREAS in Telecom Order CRTC 96-766 dated 18 July 1996 (Order 96-766), the Commission granted interim approval to the application with final approval subject to City Telecom filing, within 30 days of the Order, evidence that demonstrates that administrative controls sufficient to provide the basis for future random audits are in place;
|
WHEREAS by letter dated 15 August 1996, City Telecom filed a report which included recommendations by its technical auditor for internal administrative procedures and controls that address the requirements of Order 96-766;
|
WHEREAS City Telecom stated that it had adopted the auditor's recommendations and provided an affidavit supporting this statement;
|
WHEREAS by letter dated 28 August 1996, Bell Canada (Bell) agreed that appropriate administrative controls and procedures have been put in place to ensure that the use of the circuits in question remains unchanged over time from the configuration that existed when the Commission issued Order 96-766, and submitted that the evidence provided by City Telecom satisfies the Commission's evidentiary requirements;

WHEREAS Bell agreed that the Commission should issue an Order granting final approval to City Telecom's application; and
|
WHEREAS the Commission is of the view that City Telecom has satisfied the evidentiary requirements set out in Order 96-766 and that final approval should be granted -

IT IS HEREBY ORDERED THAT:

City Telecom's application is granted final approval effective the date of its application.
