IN THE MATTER OF an application by City Telecom Inc. (City Telecom) dated 8 April 1996, with respect to certain Canada/USA circuits used for transit traffic.

WHEREAS City Telecom enclosed a technical audit by an independent professional engineer as evidence in support of its application;
|
WHEREAS the auditor confirmed that transit traffic is originated and terminated from points outside of Canada;
|
WHEREAS by letter dated 14 May 1996, Bell Canada (Bell) agreed that the audit appears to confirm that the traffic carried on the circuits in question is transit traffic;
|
WHEREAS Bell noted that neither the auditor nor City Telecom had identified that administrative procedures or controls are in place to ensure that the configuration remains unchanged, or to record any changes;
|
WHEREAS Bell submitted that such controls are essential to ensure the ongoing validity of the requested exemption;
|
WHEREAS Bell also recommended that the use of future random audits should be considered in this case;
|
WHEREAS Bell stated that subject to the implementation of controls or administrative procedures as noted above, it agreed with the requested exemption;
|
WHEREAS Bell recommended that interim approval only be granted effective the date of application pending the provision of suitable evidence to the Commission to demonstrate that administrative controls have been implemented and are in place;
|
WHEREAS the Commission notes that City Telecom has provided evidence in accordance with Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993;
|
WHEREAS the Commission agrees with Bell's submission that City Telecom should demonstrate that administrative controls are in place capable of determining that the configuration is unchanged or to record any changes; and
|
WHEREAS such controls are helpful when performing future random audits -
|
IT IS HEREBY ORDERED THAT:
|
1. City Telecom's application is approved on an interim basis effective the date of application, with final approval subject to City Telecom filing within 30 days evidence that demonstrates that administrative controls sufficient to provide basis for future random audits are in place; and
|
2. City Telecom's configuration is subject to future random audits.
