Following Public Notice CRTC 1995-191 dated 9 November 1995, the Commission approves the application to amend the licence for the cable distribution undertaking serving Rivière-à-Claude, by adding a condition of licence relieving the licensee of the requirement of paragraph 22(1)(a) of the Cable Television Regulations, 1986 (the regulations) to distribute the priority local services of CBGAT-10 (SRC) Mont-Louis-en-Haut and CBGAT-11 (SRC) Sainte-Anne-des-Monts. The licensee will distribute instead the local signal of CBGAT-13 (SRC) Rivière-à-Claude, received over the air. Should any of the local stations for which relief is granted herein begin offering local programming, the licensee would be required to distribute the local station in question, on the basic service of its undertaking or apply to the Commission for further relief from the requirement.

The Commission also approves the licensee's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the licensee be relieved of the requirement to distribute at least four television programming services as provided for in section 23 of the regulations, so long as it does not distribute any U.S. television service or only those which may subsequently be authorized by the Commission.

The Commission notes that the licensee has requested authority to distribute, on the basic service of its undertaking, CFJP-TV (TQS) Montréal, received via satellite. In this respect, the Commission notes that this service appears on the List of Part III Eligible Satellite Services (Public Notice CRTC 1995-189 entitled "Revised Lists of Eligible Satellite Services"). Consequently, the addition of this service no longer requires the Commission's authorization.

The Commission acknowledges the opposing intervention submitted by Canadian Satellite Communications Inc. and is satisfied with the licensee's reply to the intervention.
