Licence amendment for CINC-FM
In Public Notice CRTC 1996-42 dated 22 March 1996, the Commission announced the application by Native Communication Inc. (Native) to amend the condition of licence which limits the amount of advertising it is allowed to broadcast on CINC-FM by adding the following thereto:
This condition applies solely in relation to advertisers located in the market area of CHTM Thompson, as defined in Public Notice CRTC 1990-111 entitled "An FM Policy for the Nineties".
Native indicated that this change would allow it to increase its advertising revenues through the sale of airtime to clients located outside the Thompson market area, which is the area within the 15mv/m (daytime) signal contour of CHTM, the commercial station operating in Thompson.
 
In an intervention to this application, the licensee of CHTM, Arctic Radio (1982) Limited, requested that the condition apply also in relation to advertisers located in the market areas of CJAR The Pas and CFAR Flin Flon, its two other commercial radio stations. The intervener claimed that these stations should benefit from the same protection as that given to CHTM since they rely solely on advertising revenues.
The Commission has reviewed the intervener's comments as well as the licensee's reply thereto. Taking into consideration the fact that Native's station CINC-FM has a transmitter in The Pas, the Commission is of the view that protection of CJAR's market is warranted and that CINC-FM should not be allowed to sell local advertising in that station's market area. The Commission has, therefore, determined that the condition should apply also in relation to the advertisers located in the market area of The Pas.
The Commission approves Native's application in part. Accordingly, the Commission deletes the condition of licence which limits the amount of advertising broadcast on CINC-FM and substitutes the following therefor:
It is a condition of licence that the licensee broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, in accordance with the native radio policy for Type B stations. This condition applies solely in relation to advertisers located in the market areas of CHTM Thompson and CJAR The Pas, as defined in Public Notice CRTC 1990-111 entitled "An FM Policy for the Nineties".
The Commission has also considered the intervener's request concerning Flin Flon. It has determined that the lifting of the current restrictions on the sale of advertising in Flin Flon will have no negative impact on CFAR, and that the condition need not apply in relation to the advertisers located in that market.
This decision is to be appended to the licence.
