Decision

Ottawa, 30 May 1996
Decision CRTC 96-174
Briand et Moreau Câble inc.
Grande-Rivière, Grande-Rivière-ouest, Sainte-Thérèse-de-Gaspé, Petit-Pabos and Saint-Isidore-de-Gaspé, Quebec - 952193100
Licence renewal
Following Public Notice CRTC 1996-13 dated 19 January 1996, the Commission renews the licence held by Briand et Moreau Câble inc., for the cable distribution undertaking serving the above-noted localities, from 1 September 1996 to 31 August 2003.
The operation of this undertaking is regulated pursuant to Parts I, III and IV of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
The Commission deletes the condition of licence authorizing the licensee to distribute CFTM-TV (TVA) Montréal, received via satellite from CANCOM, instead of CHAU-TV-5 Grande-Rivière. The Commission notes that the licensee now distributes CHAU-TV-5 and has ceased the distribution of CFTM-TV.
Consistent with Decision CRTC 87-744, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those U.S. television services listed in the current application or as may be authorized by the Commission.
The Commission notes that, in response to the intervention by TVOntario opposing the distribution of its educational television service, the licensee indicated that it no longer distributes this service.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
This decision is to be appended to the licence.
