Decision

Ottawa, 25 April 1996
Decision CRTC 96-112
Radio & Télévision Communautaire - Havre Saint-Pierre
Havre Saint-Pierre, Quebec - 952744100
 Licence amendment - denied
Following Public Notice CRTC 1996-19 dated 13 February 1996, the Commission denies the application by Radio & Télévision Communautaire - Havre Saint-Pierre to distribute TFO, the French-language educational television programming service operated by TVOntario, on the basic service of the cable distribution undertaking serving Havre Saint-Pierre.
An intervention was received from TVOntario objecting to the applicant's proposal to distribute its educational television service, received via satellite. The Commission draws to the applicant's attention that, pursuant to the Cable Television Regulations, 1986 and as set out in the revised list of Part III Eligible Canadian Satellite Services (Appendix to Public Notice CRTC 1996-31 dated 7 March 1996), authorization for the distribution of out-of-province educational services not receivable over the air is subject to the requirement that there be no objection on the part of the originating service. In light of TVOntario's objection, the Commission is not prepared to approve the distribution of TVOntario's service.
