Telecom Order CRTC 95-649
IN THE MATTER OF an application by Bell Canada (Bell) under Tariff Notice 5407, dated 20 January 1995, effecting an increase in local channel rates as directed in Telecom Order CRTC 94-1507, 30 December 1994 (Order 94-1507).
WHEREAS Bell noted that in Order 94-1507 the Commission directed the company to file proposed tariff pages effecting an increase in local channel rates to the level of its 1995 Local Channel Resource costs adjusted to remove the 1994 over 1992 cost increases attributable to Life Estimates and Other Factors and adjusted to recognize the finding that the analogue QVF equipment is not fungible;
WHEREAS the company submitted that the proposed rates under Tariff Notice 5407 reflect the appropriate cost exclusions;
WHEREAS, in support of Tariff Notice 5407, Bell filed revised 1995 Local Channel Resource Costs reflecting the findings in Order 94-1507;
WHEREAS Bell indicated that the proposed rates bring the company's Local Channel portfolio of services to a compensatory level and eliminate the need for a subsidy from the general body of subscribers;
WHEREAS, by letter dated 6 March 1995, the Municipality of Metropolitan Toronto (Metro) filed comments opposing the increases proposed under Tariff Notice 5407;
WHEREAS, by letter dated 17 March 1995, Bell replied to Metro's comments;
WHEREAS the Commission notes that under Tariff Notice 5102, dated 24 February 1994, Bell proposed to increase, in 1994 and 1995, the rates for local channels based on cost evidence filed in support of that Tariff Notice;
WHEREAS the Commission issued Telecom Public Notice CRTC 94-21, 8 April 1994, inviting public comment on Tariff Notice 5102;
WHEREAS in Order 94-1507 the Commission made a number of findings relating to the costing of local channels, directed Bell to file a revised proposal reflecting those findings and denied the 1995 rate increases proposed under Tariff Notice 5102; and
WHEREAS the Commission is of the view that Tariff Notice 5407 conforms with the Commission's directions in Order 94-1507 -
IT IS HEREBY ORDERED THAT:
Tariff Notice 5407 is approved.
