IN THE MATTER OF applications by AGT Limited (AGT) under Tariff Notice 631 dated 22 June 1995 and as amended by Tariff Notice 631A dated 5 July 1995, and applications by BC TEL under Tariff Notice 3329, Bell Canada (Bell) under Tariff Notice 5521, The Island Telephone Company Limited (Island Tel) under Tariff Notice 385, Manitoba Telephone System (Manitoba Tel) under Tariff Notice 141, Maritime Tel & Tel (MT&T) under Tariff Notice 542, The New Brunswick Telephone Company, Limited (NBTel) under Tariff Notice 463, and Newfoundland Telephone Company Limited (Newfoundland Tel) under Tariff Notice 435, all dated 23 June 1995, pertaining to the provision of automatic disconnection announcements to the customers of service providers that have been disconnected, and the bulk transfer of customers from the carrier identification code of one service provider to that of another.
WHEREAS on 26 July 1995, the Commission issued Telecom Order CRTC 95-832 granting interim approval to the applications referenced above with the exception of the charge associated with the "Once-only announcement creation fee" which was deferred;
WHEREAS AGT's amendment to its application filed under Tariff Notice 631A was not addressed in Telecom Order CRTC 95-832;
WHEREAS comments were received from ACC Long Distance Ltd., fONOROLA Inc., Sprint Canada Inc., and Unitel Communications Inc.;
WHEREAS the comments addressed a number of issues, including the inclusion of a mark-up in the proposed rates, the level of discount for the bulk PIC transfer charges versus the individual PIC transfer charge, and the appropriateness of treating the disconnection announcement creation fee as a start-up cost;
WHEREAS on 14 August 1995, Stentor Resource Centre Inc (Stentor) responded on behalf of the telephone companies submitting, among other things, that the inclusion of mark-ups in the rates was appropriate and that treating the announcement creation fee as a start-up cost would be contrary to Disconnection of Equal Access Service Providers and Transfer of Customer Base Between Equal Access Service Providers, Telecom Decision CRTC 95-5, 24 April 1995;
WHEREAS individual PIC transfer charge is being considered in the Equal Access proceeding established in Telecom Public Notice CRTC 94-26;
WHEREAS the Commission notes Stentor's most recent estimate of competitors' long-term market share as filed with the Commission in the proceeding established in Telecom Public Notices CRTC 94-52, 94-56 and 94-58; and
WHEREAS the Commission has considered the comments and reply received in this matter -
IT IS HEREBY ORDERED THAT:
1. AGT, Bell, BC TEL, Island Tel, Manitoba Tel, MT&T, NBTel and Newfoundland Tel are to file revised final tariffs for the one-time creation fee and activation charge associated with the disconnection announcements in which the costs are treated as a start-up cost with no mark-up and with 70% of the costs being recovered from the respective Stentor-member telephone companies and 30% from equal access providers.
2. The interim approval for charges associated with the bulk transfer of a customer base between equal access service providers will continue until such time as the Commission has reviewed these charges and made its final determination with respect to the individual PIC transfer charge in the Equal Access proceeding.
3. AGT Tariff Notice 631A is given interim approval.
