The Commission will hold a public hearing commencing on 27 February 1996, at the Sheraton Landmark, 1400 Robson Street, Vancouver, British Columbia, to consider the following:

WESTERN CANADA AND TERRITORIES REGION

1. CHILLIWACK, British Columbia
|
Application (952308500) by STAR-FM RADIO INC., P.O. Box 386, Chilliwack, British Columbia, V2P 6J7, to amend the broadcasting licence of the (radio) programming undertaking CKSR-FM Chilliwack as follows:
|
a) by decreasing the effective radiated power of its Abbotsford transmitter CFSR-FM from 16,000 to 15,000 watts and by relocating the existing Abbotsford transmitter to Mount Seymour; and
|
b) by adding a transmitter at Abbotsford operating on a frequency of 92.5 MHz (channel 223A) with an effective radiated power of 890 watts.
|
The proposed transmitter site at Mount Seymour will improve CKSR-FM's over the air signal in the Western Fraser Valley and Vancouver. The applicant has indicated the lower power transmitter at Abbotsford will address the problem of residential encroachment.

The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.

Application (950773200) by COUNTRY BROADCASTING CORP., P.O. Box 151, Black Creek, British Columbia, V0R 1C0, to renew the broadcasting licence of the (cable) distribution undertaking serving Galiano and Mayne Islands expiring 31 May 1996.
|
The licensee appeared at a Public Hearing in Saskatoon beginning on 6 June 1994 to show cause as to why its broadcasting licence to serve Galiano and Mayne Islands should be renewed because of the long delay in implementing the authority granted in Decision 91-853 dated 25 November 1991.
|
Decision CRTC 94-434 dated 21 July 1994 renewed the Class 2 (fewer than 2,000 subscribers) licence held by Country Broadcasting Corp. for the cable distribution undertaking licensed to serve Galiano and Mayne Islands from 1 September 1994 to 28 February 1995. The decision stated in part:

"It is therefore a condition of this licence that construction of this undertaking be completed and that it be in operation before the expiry of this license term. The Commission puts the licensee on notice that should it be unable to complete construction and implement the undertaking at Galiano and Mayne Islands by that time, the Commission may not be prepared to grant a further renewal of this licence, and may reassess how these communities will be best served."

Subsequently, the Commission administratively renewed the broadcasting licence three (3) times, from 1 March 1995 to 31 May 1995 (Decision CRTC 95-72 dated 28 February 1995); from 1 June 1995 to 31 December 1995 (Decision CRTC 95-268 dated 31 May 1995) and from 1 January 1996 to 31 May 1996 (Decision CRTC 95-925 dated 21 December 1995).

The undertaking is providing some service to Mayne Island, however as of 27 November 1995 service has not been provided to Galiano Island. Since the licensee has not completed construction and fully implemented the undertaking and the licensee has shown little interest in completing it, the Commission hereby calls the licensee to the Public Hearing which will be held in Vancouver commencing on 27 February 1996, to show cause as to why its broadcasting licence to serve Galiano and Mayne Islands should be renewed.

The applicant is also applying for authority to operate the station as a type "A" native community station despite its proximity to the service area of CHLW St. Paul. The criteria for types "A" and "B" native stations are outlined in Public Notice CRTC 1990-89 "Native Broadcasting Policy."
|
The Aboriginal Multi-Media Society of Alberta is currently licensed to operate the rebroadcasting transmitter VF2189 Saddle Lake and has indicated that it will surrender their authority for the above-mentioned transmitter should the Commission approve this application.
