Acquisition of assets
Following a Public Hearing in the National Capital Region beginning on 18 September 1995, the Commission approves the application for authority to acquire the assets of the cable distribution undertaking serving the above-mentioned communities, from Télécâble des Mille-Iles Inc., and for a broadcasting licence to continue the operation of this undertaking.
The Commission will issue a class 1 licence to CF Cable TV Inc., on behalf of a company to be incorporated, expiring 31 August 2001, the current expiry date, upon surrender of the current licence. The operation of this undertaking will be regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations). The authority granted herein is subject to the same conditions as those in effect under the current licence, as well as to any other condition that may be specified in the licence to be issued.
This authority will only be effective and the licence will only be issued at such time as the Commission receives documentation establishing that an eligible Canadian corporation has been incorporated and that it may be issued a licence.
In approving this application, the Commission has taken into account the fact that Télécâble des Mille-Iles Inc. is a wholly-owned subsidiary of CF Cable TV Inc. and that the transaction thus represents a corporate reorganization without any change occurring in the control, programming or management of the licensee.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, WVNY (ABC), WCAX-TV (CBS) and WETK (PBS) Burlington, Vermont, WCFE-TV (PBS) and WPTZ (NBC) Plattsburgh, New York, received via telecommunications, as part of the basic service.
The licensee is also authorized to continue to distribute, at its option, the Vidéotron Ltée special programming service, "Le Canal Événement".
Further, consistent with Decision CRTC 90-1021, the licensee is authorized to continue to distribute a specialty ethnic programming service. It is a condition of licence that the licensee shall not distribute as part of this ethnic service any commercial message other than a sponsorship credit, included in the program credits, which combines no more than the logo, name, address and type of activity or profession of the sponsor. The sponsorship credit may contain sound and/or visual images, whether moving or fixed. The sponsorship credit shall have no purpose other than to acknowledge, in a concise and direct manner, the sponsor's contribution and shall at no time, correspond to a detailed description or promotional device. The licensee is also authorized, on an exceptional basis, to add English- or French-language subtitles to feature films on the specialty multicultural programming service, provided that these subtitles are an integral part of the original production.
In accordance with previous decisions, the Commission relieves the licensee, by condition of licence, of the requirement of paragraph 9(1)(c) of the regulations that it distribute, as part of the basic service and on the basic band if channels are available, the programming service of the priority television station CFTU-TV (IND) Montréal. However, the licensee must continue to distribute CFTU-TV as part of the basic service.
Consistent with Decision CRTC 90-1021, the licensee is relieved, by condition of licence, of the requirement to distribute the carrier current radio programming service of CIRL Montréal, a priority local station.
The Commission notes that the proposed distribution of the Greek radio service conforms with paragraph 16(3)(d) of the regulations.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets that will be allocated for this purpose during the new licence term. The Commission expects the licensee to increase its community programming budget during the next term to the 5% bench mark level established by the Commission.
In Public Notice CRTC 1992-59 the Commission announced implementation of its employment equity policy. It advised licensees that, at the time of licence renewal or upon considering applications for authority to transfer ownership or control, it would review with applicants their practices and plans to ensure equitable employment. In keeping with the Commission's policy, it encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources. It also encourages the licensee to continue the general approach taken by Télécâble des Milles-Îles Inc. in this regard.
