Télécâble des Mille-Iles Inc., Terrebonne, Quebec - 893617100
Following a Public Hearing in Montréal beginning on 13 March 1990, the Commission renews the Class 1 licence for the broadcasting receiving undertaking serving Terrebonne, held by Télécâble des Mille-Iles Inc., from 1 October 1990 to 31 August 1995. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, WVNY (ABC) and WCAX-TV (CBS) Burlington, Vermont as well as WCFE-TV (PBS) and WPTZ (NBC) Plattsburgh, New York, received via microwave.
In accordance with previous decisions, the Commission relieves the licensee, by condition of licence, of the requirement of paragraph 9(1)(c) of the regulations that it distribute the programming service of the priority television station CFTU-TV Montréal on the basic band of the basic service, if channels are available. However, the licensee must continue to distribute CFTU-TV on the basic service.
Further, the Commission authorizes the licensee to continue to distribute a specialty ethnic programming service. It is a condition of licence that the licensee shall not distribute as part of this ethnic service any commercial message other than a sponsorship credit, included in the program credits, which combines no more than the logo, name, address and type of activity or profession of the sponsor. The sponsorship credit may contain sound and/or visual images, whether moving or fixed. The sponsorship credit shall have no purpose other than to acknowledge, in a concise and direct manner, the sponsor's contribution and shall at no time, correspond to a detailed description or promotional device. The licensee is also authorized, on an exceptional basis, to add English- or French-language subtitles to feature films on the specialty multicultural programming service, provided that these subtitles are an integral part of the original production.
The Commission approves the licensee's request regarding section 16 of the regulations. Accordingly, the licensee is relieved, by condition of licence, of the requirement to distribute the programming service of CIRL Montréal, which is a priority local station. In approving this request, the Commission has taken into consideration the licensee's argument that CIRL is a carrier current station which serves only Loyola University in Montreal.
The Commission notes Télécâble des Mille-Îles Inc.'s commitment to increase its annual budget for community programming from $167,000 in the first year of the new licence term to $215,000 in the fifth year. Moreover, the Commission notes that, following the release of Public Notice CRTC 1990-57 dated 5 June 1990, it initiated a review of its policy relating to community channels, particularly the level of financial support required for community programs. The Commission encourages the licensee to increase its annual contribution to the community channel in proportion to the income derived from its basic service.
The Commission received a written intervention from TVOntario opposing the licensee's distribution of TVO's signal by satellite. In this regard, the Commission notes that all of the signals which the licensee distributes are received from the head-end of Inter-Vision Montréal, of which the licensee is co-owner. In view of the foregoing, the Commission considers that the licensee is in compliance with subsection 9(3) of the regulations, which provides that "an educational television programming service the operation of which is the responsibility of an educational authority designated by a province other than the province in which the licensed area of the undertaking is located" may be distributed as part of the basic service if it is received over-the-air.
