Extension of construction deadline and revocation of licence

In Public Notice CRTC 1995-119 dated 14 July 1995, the Commission announced that it had received from Télécâble Provincial Inc. applications to amend the licences for the cable distribution undertakings authorized to serve the above-mentioned communities by extending until 31 July 1996 the deadline for the construction and implementation of the undertakings.

The Commission approves the applications to amend the licences for the cable distribution undertakings authorized to serve Sainte-Hélène-de-Bagot, Saint-Théodore-d'Acton and Saint-Hugues by deleting the existing condition of licence relating to the construction and operation of the undertakings and substituting therefor:

It is a condition of licence that construction of the undertaking be completed and the undertaking be in operation on or before 31 August 1996.

The licensee was authorized to serve the above-noted communities on 3 September 1993 (Decision CRTC 93-577). The Commission notes that these applications are the second requests for an extension of the deadline for implementation. Further, the Commission notes that the licences expire on 31 August 1996 and that as of the expiry date, the licensee will have had three years to provide service. Accordingly, should the licensee not complete construction of these undertakings and implement service on or before 31 August 1996, the Commission will wish to reassess the situation in order to determine if the renewal of these licences is in the public interest.

With regard to the undertaking authorized to serve Saint-Jude and Saint-Bernard, the Commission received an intervention from the Municipality of Saint-Jude opposing an extension of the deadline for construction. The intervener indicated that a third party would be able to serve Saint-Jude without delay. Following this intervention, the licensee requested the revocation of its licence for that undertaking.

Revocation

In view of the licensee's request and pursuant to paragraph 9(1)(e) and subsection 24(1) of the Broadcasting Act, the Commission hereby revokes the licence issued to Télécâble Provincial Inc. for the undertaking authorized to serve Saint-Jude and Saint-Bernard.
