Addition of WTOL-TV

Following Public Notices CRTC 1995-33 dated 1 March 1995 and CRTC 1995-33-1 dated 13 March 1995, the Commission approves the applications submitted by CANCOM on behalf of the cable licensees listed in the appendix to this decision, to amend their respective licences by deleting the condition of licence authorizing the distribution of WJBK-TV (CBS) Detroit, Michigan, and by adding a condition of licence authorizing the distribution of WTOL-TV (CBS) Toledo, Ohio, received via satellite from CANCOM, as part of the basic service.

These applications were submitted following Decision CRTC 94-897 dated 28 November 1994, in which the Commission authorized CANCOM to replace WJBK-TV (CBS) Detroit, Michigan with WTOL-TV (CBS) Toledo, Ohio, on the list of signals that it is authorized to distribute, and requested that CANCOM, acting as an agent on behalf of its affiliate Class 1 and Class 2 cable licensees currently authorized to distribute WJBK-TV, file an application with the Commission to amend each licence accordingly.

The Commission notes that undertakings regulated pursuant to Parts I and III of the Cable Television Regulations 1986 are not required to submit an application as a result of the replacement of WJBK-TV by WTOL-TV. Therefore, no further action is required with respect to the application (942388000) submitted on behalf of the undertaking serving Bridgetown, licensed to Joseph P. Shannon included in Public Notice CRTC 1995-33-1.

The Commission acknowledges the interventions received with respect to these applications as well as CANCOM's reply.
