Decision

Ottawa, 10 February 1995
Decision CRTC 95-37
Association canadienne-française de l'Ontario-Conseil régional de Nipissing
North Bay, Ontario - 941984700
Special event licence
Following a Public Hearing held in the National Capital Region on 10 February 1995, the Commission approves the application for a broadcasting licence for a French-language FM community radio programming undertaking at North Bay, on the frequency 93.5 MHz (channel 228LP), with an effective radiated power of 33 watts, to broadcast programs during various winter carnival activities and to stimulate interest for community radio in the District of Nipissing.
Pursuant to Public Notice CRTC 1992-38 dated 29 May 1992 entitled "Policies for Community and Campus Radio", the Commission will issue a licence for a Type A community radio station, which will be in effect on 11 and 12 February 1995, subject to the conditions specified in the licence to be issued.
The Department of Industry, Science and Technology (DIST) has advised that the undertaking will broadcast on the frequency 93.5 MHz (channel 228LP) and will have an effective radiated power of 33 watts rather than on the frequency 93.5 MHz (channel 228B) with an effective radiated power of 30 watts, as had been indicated in Notice of Public Hearing CRTC 1994-17 dated 9 December 1994.
The DIST has also advised the Commission that this application is conditionally technically acceptable, and that a Broadcasting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence and the authority granted herein may only be implemented, at such time as written notification is received from the DIST that its technical requirements have been met, and that a Broadcasting Certificate will be issued.
Allan J. Darling
Secretary General
