Licence renewals
Following Public Notice CRTC 1994-146 dated 2 December 1994, the Commission renews the Class 2 (fewer than 2,000 subscribers) licences held by Emtel Inc., for the cable distribution undertakings serving the above-mentioned communities, from 1 September 1995 to 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act (the Act), will enable the Commission to consider the next licence renewal of these undertakings in accordance with the Commission's regional plan and to better distribute the workload within the Commission. This term is not reflective of any Commission concern regarding the licensee's performance.
With the exception of the requirements stipulated in section 23 of the Cable Television Regulations, 1986 (the regulations), the operation of these undertakings is regulated pursuant to Parts I and III of the regulations and the licences will be subject to the conditions in effect under the current licences as well as to those conditions specified in the licences to be issued.
The licensee has requested to be relieved of the requirement of subsection 9(1) of the regulations to distribute the extra-regional television signals of CHLF-TV-2 (La Chaîne), CICO-TV-96 (TVO) Hawkesbury and CFMT-TV-1 (IND) Ottawa as well as of the requirement of subsection 16(2) to distribute the local radio services of CISM-FM and CKIS Montréal. In this regard, the Commission notes that since the operation of these undertakings is now regulated pursuant to Parts I and III of the regulations, the licensee is no longer required to distribute these signals. The Commission acknowledges the opposing intervention received from CISM-FM and the licensee's reply to the intervention.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, CFTU-TV (IND) Montréal and WETK (PBS) Burlington, Vermont, received via microwave, as part of the basic service of the undertaking serving Sainte-Justine de Newton.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
