Licence renewal for CFEL-FM
Following Public Notice CRTC 1994-146 dated 2 December 1994, the Commission renews the broadcasting licence for CFEL-FM Montmagny from 1 September 1995 to 31 August 2002, subject to the conditions in effect under the current licence, as well as to those conditions specified in the licence to be issued.
The Commission approves the application to amend the licence for CFEL-FM, by deleting existing Promise of Performance commitments for station-produced programming.
This amendment is consistent with the policy set out in Public Notice CRTC 1993-121 dated 17 August 1993 entitled "Local Programming Policy for FM Radio - Definition of a Single-Station Market".
In accordance with the policy outlined in that public notice, CFEL-FM has been identified as operating in a single-station market and may solicit and accept local advertising, irrespective of the amount of local programming it broadcasts.
The Commission reaffirms the particular importance it attaches to the development of Canadian talent. As part of its renewal application, the licensee indicated that it was unable to make a commitment in direct expenditures to Canadian talent development because of the station's financial difficulties. The Commission will expect the licensee to make direct cost contributions to the development of Canadian talent once the station achieves a positive operating income, the profit before interest and tax (PBIT) index being the primary profitability indicator.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
In accordance with subsection 22(1) of the Broadcasting Act, this renewal is subject to the renewal of the Broadcasting Certificate issued by the Department of Industry.
The Commission draws the licensee's attention to subsection 22(4) which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 is of no force or effect.
