Licence renewal
Following Public Notice CRTC 1994-146 dated 2 December 1994, the Commission renews the licence held by Coopérative de câblodistribution de Ste-Catherine Fossambault, for the cable distribution undertaking serving Duchesnay, from 1 September 1995 to 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act (the Act), will enable the Commission to consider the next licence renewal of this undertaking in accordance with the Commission's regional plan and to better distribute the workload within the Commission. This term is not reflective of any Commission concern regarding the licensee's performance.
The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
The Commission approves, by condition of licence, the licensee's request to be relieved from the requirement of subsection 22(1) of the regulations to distribute the regional signal of CFAP-TV (TQS) Quebec City on the basic band (channels 2 to 13). The Commission notes that the licensee will distribute this signal on channel 19.
An intervention was received from TVOntario objecting to the licensee's proposal to distribute TVOntario programming (CICA-TV Toronto) received via satellite. The Commission draws to the licensee's attention that, pursuant to the regulations and as set out in the revised list of Part III Eligible Canadian Satellite Services (Appendix to Public Notice CRTC 1995-8 dated 19 January 1995), authorization for the distribution of out-of-province educational services not receivable over the air is subject to the requirement that there be no objection on the part of the originating service. In light of TVOntario's objection, the Commission is not prepared to approve the proposed distribution of CICA-TV. The Commission notes the licensee's reply to the intervention wherein it indicates that it would cease distribution of the TVOntario service.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
In accordance with subsection 22(1) of the Act, this renewal is subject to the renewal of the Broadcasting Certificate issued by the Department of Industry.
The Commission draws the licensee's attention to subsection 22(4) which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 is of no force or effect.
