Licence renewal
Pursuant to Public Notice CRTC 1994-159 dated 23 December 1994, the Commission renews the Class 2 licence held by Wood Lake Cable Ltd. (formerly Wood Lake Video Ltd.), for the cable distribution undertaking serving Oliver and Osoyoos, from 1 September 1995 to 31 August 2001.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act (the Act), will enable the Commission to consider the next licence renewal of this undertaking in accordance with the Commission's regional plan and to better distribute the workload within the Commission. The term is not reflective of any Commission concern regarding the licensee's performance.
The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to distribute, at its option, WDIV (NBC) and WTVS (PBS) Detroit, Michigan, received via satellite from the CANCOM network, as part of the basic service.
In its renewal application, the licensee had proposed to continue to distribute WJBK-TV Detroit, Michigan, received via satellite from the CANCOM network. This station, however, is no longer a CBS affiliate, and is no longer distributed by CANCOM. Instead, CANCOM has been authorized to carry WTOL-TV (CBS) Toledo, Ohio (Decision CRTC 94-897 dated 28 November 1994). In Public Notice CRTC 1995-33 dated 1 March 1995, the Commission announced an application by CANCOM, acting as an agent for Wood Lake Cable Ltd., to amend Wood Lake's licence by deleting the condition of licence authorizing the distribution of WJBK-TV, and adding a condition of licence authorizing the distribution of WTOL-TV, received via satellite from the CANCOM network, as part of the basic service.
As part of the licence renewal application, the licensee also requested authority to add the distribution, at its option, of WXYZ-TV (ABC) Detroit, Michigan, received via satellite from the CANCOM network, as part of the basic service, and KSPS-TV (PBS), KHQ-TV (NBC) and KREM-TV (CBS) Spokane, Washington, received off-air, as part of the basic service. The licensee also requested authority to continue to distribute KXLY-TV (ABC) Spokane, Washington.
The licensee proposes to distribute more than one affiliate of the ABC, NBC, CBS and PBS networks, which is contrary to the Commission's policy guidelines with respect to the distribution of U.S. network signals. The licensee has not convinced the Commission that a departure from the general policy guidelines is justified in this case. Accordingly, the Commission denies the duplicate carriage of any of the U.S. network signals and expects the licensee to advise it as to which programming services it has elected to carry.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. In this regard, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
In accordance with subsection 22(1) of the Act, this renewal is subject to the issuance of a Broadcasting Certificate by the Department of Industry.
The Commission draws the licensee's attention to subsection 22(4) which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 is of no force or effect.
