New radiocommunication distribution undertaking
Following a Public Hearing in the National Capital Region held on 18 August 1994, the Commission approves the application for a licence to carry on a radiocommu- nication distribution undertaking consisting of two low-power television transmitters to serve Sachs Harbour.
The applicant falls within the definition of a municipal government as set out in section 2 of the Direction to the CRTC (Ineligibility to Hold Broadcasting Licences) (the Direction). The Commission is satisfied that all of the criteria set out in section 4 of the Direction have been met and, accordingly, will issue a licence expiring 31 August 1999. The licence will be subject to the conditions specified in this decision and in the licence to be issued.
This undertaking will distribute, in non-encrypted mode, the programming services of CITV-TV (IND) Edmonton and CHAN-TV (CTV) Vancouver, on channels 10 and 7 respectively, each with a transmitter power of 5 watts.
The Commission notes that the applicant has advised that it will not distribute the programming services of CBC Northern Television Service, Television Northern Canada and The Sports Network as had been indicated in its application and in CRTC Notice of Public Hearing 1994-9 dated 16 June 1994.
It is a condition of licence that the licensee ensure, to the satisfaction of the Commission, that the signals it transmits in non-encrypted mode are not receivable with acceptable technical quality within the authorized service area or service contours, as currently authorized, of any neighbouring subscription-based distribution undertaking.
It is a condition of licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
