Licence renewal
Following a Public Hearing in Montréal beginning on 11 October 1994, the Commission renews the Class 1 licence held by Cogeco Cable Canada Inc., for the cable distribution undertaking serving Saint-Hyacinthe, from 1 September 1995 to 31 August 2001. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
The licence term granted herein, while less than the maximum of seven years permitted by the Broadcasting Act, will enable the Commission to consider the next licence renewal of this undertaking in accordance with the Commission's regional plan and to better distribute the workload within the Commission. This term is not reflective of any Commission concern regarding the licensee's performance.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to distribute, at its option, the programming services of WVNY (ABC), WCAX-TV (CBS), WETK-TV (PBS) Burlington, Vermont and WPTZ (NBC) Plattsburgh, New York, received via microwave, as part of the basic service.
Consistent with Decision CRTC 89-707 dated 18 September 1989, and pursuant to section 12 of the regulations, the licensee is relieved, by condition of licence, of the requirement that it distribute the signals of CBFT, CFTM-TV and CFCF-TV Montréal, as well as the signals of CKSH-TV and CHLT-TV Sherbrooke on unrestricted channels. Should the quality of any of these signals deteriorate significantly, the Commission expects the licensee to undertake immediate corrective action including, if necessary, the distribution of that service on another channel.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the licensee's expenses in the last year and of the annual budgets which will be allocated for community programming during the new licence term. The Commission commends the licensee for its efforts and encourages it to continue to develop community programs that reflect subscriber interests and concerns.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
