REVISED LISTS OF ELIGIBLE SATELLITE SERVICES

Attached to this Public Notice are revised lists of "Part II Eligible Satellite Services" (Part II list), "Part III Eligible Canadian Satellite Services" (Part III Canadian list), and "Part III Eligible non-Canadian Satellite Services" (Part III non-Canadian list).

The Part II list (Appendix A) contains satellite services authorized for distribution by licensees holding a Class 1 licence, or a Class 2 licence for an undertaking that has between 2,000 and 6,000 subscribers. The Part III Canadian and non-Canadian lists (Appendix B) contain satellite services authorized for distribution by licensees holding a Part III licence or licensees holding a Class 2 licence for an undertaking that has fewer than 2,000 subscribers.

WUHF-TV Rochester
|
WUHF-TV Rochester, New York is a U.S. television station affiliated with the FOX network. In Decision CRTC 94-702 of today's date, the Commission has approved an application by Canadian Satellite Communications Inc. (CANCOM) to amend its broadcasting licence to carry on a multiple channel television and radio broadcasting distribution undertaking, by adding the signal of WUHF-TV (FOX) Rochester to the signals it is authorized to distribute.

In Public Notice CRTC 1994-107, also of today's date, the Commission has announced certain modifications to its policy governing the cable carriage of U.S. network signals, the effect of which is to permit the distribution by cable licensees of the signal of a FOX affiliate, subject to certain requirements.
|
In the case of a Class 1 cable licensee, or of a Class 2 cable licensee having between 2,000 and 6,000 subscribers, such distribution is subject to the provision that either the signal of the FOX affiliate, or the authorized signal of an affiliate of one of the other three conventional commercial U.S. networks (ABC, CBS and NBC), be distributed on a discretionary tier (encrypted or unencrypted), and packaged in accordance with the Commission's distribution and linkage requirements.

In order to authorize the distribution of the WUHF-TV signal by Class 1 licensees, and by larger class 2 licensees, on a discretionary tier, and by Part III licensees, and by Class 2 cable licensees having fewer than 2,000 subscribers, either as part of the basic service tiers or on a discretionary basis, WUHF-TV has been added to the Part II and the Part III Canadian lists.

Pay Audio Programming Services
|
In Decision CRTC 94-670 dated 23 August 1994, the Commission rescinded Decisions CRTC 93-235 and 93-236 with respect to applications by Shaw Cablesystems Ltd., on behalf of DMX Canada Ltd., and by Cogeco Radio-Télévision Inc., approving their proposals for new pay audio programming undertakings. The decision to rescind followed a public hearing held on 21 April 1994 to reconsider the two 1993 decisions pursuant to the Order in Council P.C. 1993-1799 dated 23 September 1993.

In light of Decision CRTC 94-670, the Commission has deleted pay audio programming services from the Part II and Part III Canadian lists.

- When this list of Part II Eligible Satellite Services is replaced by another list of Part II Eligible Satellite Services, the only authorized services will be those contained in the most recent list; accordingly, this list supersedes the list dated 8 June 1994.
|
- In the case of CANCOM signals, ASN, the CBC English- and French-language Television Services, U.S. satellite services, and any licensed pay audio programming services, licensees are required to enter into the necessary contractual arrangements for such carriage.
|
- In the case of Country Music Television, licensees may continue to distribute this service only until such time as the Canadian specialty service known as "The Country Network" first becomes available to affiliates, at which time authority for the distribution of Country Music Television shall cease.

- In the case of CFTM-TV and CHAN-TV, a licensee also distributing the signal of a local TVA/CTV affiliate shall delete the duplicate programming from the CANCOM services or substitute the local service(s) when the programming is identical.
|
- In the case of Country Music Television, licensees may continue to distribute this service only until such time as the Canadian specialty service known as "The Country Network" first becomes available to affiliates, at which time authority for the distribution of Country Music Television shall cease.
