Addition of WUHF-TV (FOX)
Pursuant to Public Notice CRTC 1994-68 dated 10 June 1994, the Commission approves the application to amend the broadcasting licence to carry on a multiple channel television and radio broadcasting distribution undertaking by adding the signal of WUHF-TV (FOX) Rochester, New York to the list of signals that CANCOM is authorized to distribute. This approval is consistent with the modification to the Commission's policy governing the cable carriage of U.S. network signals announced in Public Notice CRTC 1994-107 of today's date.
In Public Notice CRTC 1994-108, also of today's date, and entitled "Revised Lists of Eligible Satellite Services", the Commission has added WUHF-TV to the lists of the Part II and Part III Eligible Satellite Services thereby authorizing the distribution of this signal, on a discretionary tier by Class 1 licensees and by Class 2 licensees having between 2,000 and 6,000 subscribers; and either as part of the basic service or on a discretionary tier by Part III licensees and by smaller Class 2 licensees.
As also stated in Public Notice CRTC 1994-107, the Commission notes that the current "3+1" policy does not allow for the distribution of duplicate network services, except for those services received directly over the air at the cable licensee's local head end. However, the Commission notes that paragraph 10(1)(h) of the Cable Television Regulations, 1986, at the same time, permits Class 1 licensees and Class 2 licensees with between 2,000 and 6,000 subscribers, to distribute, without the Commission's prior approval, duplicate U.S. conventional commercial and non-commercial network signals if obtained from CANCOM by way of the Commission's lists of Eligible Satellite Services. The Commission hereby puts CANCOM on notice that it will wish to discuss with the licensee, at the time of its licence renewal scheduled for 3 October 1994, the appropriateness of revising this provision so as to preclude duplicate distribution on cable of all U.S. network signals currently distributed by CANCOM.
The Commission acknowledges the interventions in support of and in opposition to this application submitted by individuals, members of the cable industry and members of the broadcasting industry. The various issues raised in the opposing interventions have been dealt with in Public Notice CRTC 1994-107.
