Licence renewal
Pursuant to Public Notice CRTC 1994-28 dated 21 March 1994, the Commission renews the Class 2 (fewer than 2,000 subscribers) licence held by Transvision Plus Inc., for the cable distribution undertaking serving Waterloo, from 1 September 1994 to 31 August 2000, subject to the conditions in effect under the current licence, as well as to those conditions specified in the licence to be issued.
This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.
As a consequence of amendments to the Cable Television Regulations, 1986 (the regulations) announced in Public Notice CRTC 1994-7 dated 3 February 1994, the operation of this Class 2 cable distribution undertaking with fewer than 2,000 subscribers is now regulated pursuant to Parts I and III of the regulations, with the exception of the requirements stipulated in section 23.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, to continue to distribute, at its option, the programming service of the distant television station CFTU-TV Montréal and the programming service of WCFE-TV (PBS) Plattsburgh, New York, received via optical fibre, as part of the basic service.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
The Department of Industry, Science and Technology has advised the Commission that it is prepared to renew the Broadcasting Certificate for a period of two years only, expiring 31 August 1996. With respect to the operation of this undertaking beyond this period, the Commission draws the licensee's attention to subsection 22(1) of the Broadcasting Act pertaining to the technical certification of broadcasting undertakings and to subsection 22(4) which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 is of no force or effect.
