Licence renewal
Pursuant to Public Notice CRTC 1993-161 dated 23 November 1993, the Commission renews the licence held by Câble Télé Plus Québec 1 Inc. for the cable distribution undertaking serving Rivière-à-Pierre, from 1 September 1994 to 31 August 1998. This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.
The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions in effect under the current licence, as well as to those conditions specified in this decision and in the licence to be issued.
Consistent with Decision CRTC 92-225 dated 10 April 1992, the licensee is relieved, by condition of licence, from the requirement of paragraph 22(1)(b) of the regulations that it distribute the priority service CFAP-TV Quebec City in view of the poor quality of this signal. The licensee is authorized to continue to distribute instead CFJP-TV Montréal, received via satellite.
Consistent with Decision CRTC 90-797 dated 24 August 1990, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those U.S. television services listed in the current application or as may be authorized by the Commission.
In Public Notice CRTC 1992-59 dated 1 September 1992 and entitled "Implementation of an Employment Equity Policy", the Commission announced that the employment equity practices of broadcasters would be subject to examination by the Commission. It encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
The Department of Communications has advised the Commission that it is prepared to renew the Broadcasting Certificate for a period of two years only, expiring 31 August 1996. With respect to the operation of this undertaking beyond this period, the Commission draws the licensee's attention to subsection 22(1) of the Broadcasting Act pertaining to the technical certification of broadcasting undertakings and to subsection 22(4) which provides that any broadcasting licence issued, amended or renewed in contravention of section 22 is of no force or effect.
