Licence amendment related to CFBK-FM
Pursuant to Public Notice CRTC 1993-124 dated 23 August 1993, the Commission approves the application by Muskoka-Parry Sound Broadcasting Limited (Muskoka-Parry Sound) to amend the Promise of Performance for CFBK-FM Huntsville by increasing the weekly maximum level of hits from less than 50% to 100%.
Muskoka-Parry Sound's proposal constitutes an exemption to the Commission's FM Policy outlined in CRTC Public Notice 1990-111 dated 17 December 1990, which requires FM stations to restrict their use of hits to less than 50% of all music selections broadcast each week. The applicant has requested flexibility based on Public Notice CRTC 1992-3 "Guidelines for Assessing Applications for Programming Flexibility From Licensees of Radio Stations in Border Markets and Small Markets" (the Guidelines). The Guidelines stipulate, as criteria for small market stations, a market population of less than 100,000 and unprofitability of the market.
In support of its request, the licensee has indicated that the growing influence of out-of-market stations, as a consequence of recent power increases and other programming adjustments, has resulted in the first decline in 14 years in station revenues, and a possible financial loss in the 1992/93 broadcast year. The licensee considers that the proposed programming change would provide CFBK-FM with a competitive edge on a local level and would encourage increased listenership.
The Commission notes that while the population of the Huntsville market is less than 100,000, CFBK-FM, the only station in the market, has been profitable in each of the past five years. Under the Commission's guidelines, therefore, CFBK-FM would not automatically qualify for consideration under the policy.
However, the Commission has taken into consideration the fact that Huntsville is considered as a single-station market and, therefore, this increase in the hit level would have a minimal impact on other stations. Furthermore, the Commission notes that it has received no interventions opposing this amendment.
