Licence amendments
|
Pursuant to Public Notice CRTC 1993-157 dated 12 November 1993, the Commission approves, by condition of licence, the application to amend the licence for the Class 2 (fewer than 2,000 subscribers) cable distribution undertaking serving Saint-Adalbert by authorizing the licensee to act as a Part III licensee under the applicable sections of the Cable Television Regulations, 1986 (the regulations).

In approving this application, the Commission has taken into account the fact that the licensee is a cooperative, that it serves only 123 subscribers and that it has already been authorized to distribute two CANCOM signals as well as two other signals received via satellite in view of the poor quality of the two signals received over the air. Accordingly, the Commission has determined that the operation of the undertaking may be regulated pursuant to Parts I and III of the regulations.

The Commission approves, by condition of licence, the licensee's request to be relieved from the requirement of paragraph 22(1)(a) of the regulations that it distribute CFAP-TV Quebec City, a local television service, and from the requirement of paragraph 22(1)(b) of the regulations that it distribute CKMI-TV Quebec City, a regional television service, in view of the poor reception quality of these priority services as confirmed by the Department of Communications. The licensee is authorized to distribute instead CFJP-TV and CBMT Montréal, received via satellite.

The Commission approves the licensee's request with respect to
section 23 of the regulations. Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services as provided for in section 23 of the regulations, so long as it distributes only those U.S. television services listed in the current application or as may be authorized by the Commission. In approving this request, the Commission has taken into account the linguistic makeup of the community served by the undertaking which is exclusively francophone. The Commission notes the intervention filed by the Canadian Satellite Communications Inc. in this regard. |
