Pursuant to Public Notice CRTC 1992-75 dated 6 November 1992, the Commission approves the application to amend the broadcasting licence for CHME-FM Les Escoumins, by relocating the transmitter site from the north shore of the St. Lawrence River to the south shore of the river at Sainte-Françoise, by changing the frequency from 95.1 MHz to 94.9 MHz, and by increasing the effective radiated power from 12 watts to 567 watts.

The licensee has indicated that approval of this application will extend the coverage area to serve listeners located along the upper north shore. CHME-FM thus becomes a regional station.

The Commission acknowledges the joint intervention submitted by CIBM-FM Mont-Bleu Ltée and Radio CJFP (1986) Ltée and the intervention submitted by Radio Côte-Nord Inc., licensee of radio stations CHLC Baie-Comeau and CFRP Forestville, opposing this application. The Commission is satisfied with the licensee's reply to these interventions. Nevertheless, the Commission expects the licensee to honour its commitment not to solicit or sell advertising on the south shore of the St. Lawrence River. In addition, the Commission reminds the licensee that CHME-FM's licence is subject to the condition that it broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any given hour, in accordance with the native radio policy for Type B stations. The Department of Communications (DOC) has advised the Commission that this application is conditionally technically acceptable, and that an amendment to the Broadcasting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendment, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that its technical requirements have been met, and that an amendment to the Broadcasting Certificate will be issued.
