Pursuant to Public Notice CRTC 1993-10 dated 17 February 1993, the Commission approves the application submitted by CJRN 710 Inc. (CJRN) to amend the licence for CKEY-FM Fort Erie by:
a) deleting the following terms of licence concerning the antenna site location, as set out in CKEY-FM's licence:
 ... with the broadcasting transmitting antenna(s) located at a site(s) authorized by the Commission.
b) replacing the terms of the licence concerning the contours and particulars contained in the approved application and the studio location, with the following condition of licence:
 It is a condition of licence that the undertaking be operated on the basis of the contours and particulars contained in the approved application, except as otherwise authorized by the Commission in writing.
In approving this request, the Commission has taken into consideration the fact that it has received no interventions opposing this proposal. Furthermore, the Commission notes that, in the spring of 1991, the licensee established CKEY-FM's studios temporarily on the premises of CJRN Niagara Falls, pending construction of new studios at Fort Erie. The licensee subsequently submitted an application to the Commission requesting authority to establish CKEY-FM's studios at Niagara Falls permanently.
In view of the approval granted herein, no further action is required regarding that application (921792800) announced in Public Notice CRTC 1993-9 dated 17 February 1993. The Commission notes, however, the licensee's strong assurances, contained in that application, that it "would continue to recognize the priority of Fort Erie and the Niagara South" in the station's programming. Specifically, the licensee indicated that it would provide news coverage separate from that broadcast by CJRN and directed particularly to Fort Erie. Moreover, the licensee stated that "to the listener, CKEY-FM is Fort Erie; CJRN is Niagara Falls". The Commission emphasizes the importance it attaches to the licensee maintaining CKEY-FM's orientation to Fort Erie and Niagara South.
The Commission also approves the licensee's request to delete the requirements contained in CKEY-FM's Promise of Performance, Part II, specifying a minimum weekly number of distinct musical selections, excluding repeats, and a maximum number of times a distinct musical selection may be broadcast.
CJRN submitted this application subsequent to Public Notice CRTC 1992-72 dated 2 November 1992, and entitled "A Review of the CRTC's Regulations and Policies for Radio", in which the Commission announced that it would be prepared to eliminate the requirement for radio stations to seek approval from the Commission for the relocation of antenna sites and broadcast studios. The Commission will still require licensees of radio stations to apply to the Commission for approval to change their coverage area. In Public Notice CRTC 1992-72, the Commission also announced that it would remove the policy requirement for commercial English-language FM stations limiting the number of times a non-Canadian musical selection may be repeated (the maximum repeat factor), as well as the requirement that these stations ensure that a minimum of 850 distinct musical selections be broadcast each week.
