Application (920402500) by BLUE WATER BROADCASTING LIMITED, 1415 London Road, Clearwater, Ontario, N7S 1P6, for a broadcasting licence to carry on an English-language (Group II - Country and Country-Oriented) FM radio programming undertaking at Leamington, operating on a frequency of 96.7 MHz with an effective radiated power of 21,200 watts (average).
Blue Water Broadcasting Limited proposes to cease the operation of CHYR/CHYR-7, its AM station in Leamington, with the implementation of the FM service. CHYR/CHYR-7's current frequency is 710 kHz (day) and 730 kHz (night).
The application entails the following conditions of licence:
a) to broadcast a weekly minimum Spoken Word level of 12% of the broadcast week;
b) to broadcast a weekly minimum level of 20% Canadian selections with respect to Category 2 music;
c) to broadcast a minimum weekly music list of 579 distinct musical selections;
d) to broadcast a maximum weekly repeat factor of 28; and e) to broadcast a maximum weekly hit percentage of 80%.
With respect to paragraphs a) and b), Sections 13 and 2.2 of the Radio Regulations, 1986 require a minimum of 15% Spoken Word and a minimum of 30% Canadian content with respect to category 2 music, as outlined in Public Notice CRTC 1991-89 entitled "Amendments to the Radio Regulations, 1986", except as otherwise provided pursuant to a condition of licence.
Proposals c), d) and e), entail exemptions from the Commission's FM Policy requiring a weekly music list of at least 850 distinct musical selections, a maximum weekly repeat factor of 18 and a hit level of less than 50% of all popular music selections, as outlined in Public Notice CRTC 1990-111 entitled "An FM Policy for the Nineties".
The applicant is seeking flexibility in these areas to enable it to better compete with the U.S. signals available in the Leamington market.
Public Notice 1992-3, Guidelines for Assessing Applications for Programming Flexibility from Licensees of Radio Stations in Border Markets and Small Markets states that broadcasters requesting programming flexibility will have to demonstrate to the Commission the need for such flexibility.

The proposals in paragraph e) entail exemptions from the Commission's FM policy requiring the broadcast of at least 3 hours of news per week, a weekly music list of at least 850 distinct musical selections, a maximum repeat factor of 18 and a hit level of less than 50% of all popular music selections, as outlined in Public Notice CRTC 1990-111 entitled "An FM Policy for the Nineties".
With respect to paragraphs d) and g), Sections 13 and 2.2 of the Radio Regulations, 1986 require a minimum of 15% Spoken Word and a minimum of 30% Canadian content with respect to category 2 music, as outlined in Public Notice CRTC 1991-89 entitled "Amendments to the Radio Regulations, 1986", except as otherwise provided pursuant to a condition of licence.
The applicant is seeking flexibility in these areas to enable it to better compete with the U.S. signals available in the Windsor market.
