Following a Public Hearing in the National Capital Region beginning on 21 September 1992, the Commission renews the Class 2 (fewer than 2,000 subscribers) licence held by Câblevision Gatineauval Inc., for the cable distribution undertaking serving the above-mentioned communities, from 1 January 1993 to 31 August 1995. This term will allow the Commission a reasonable period of time to assess the performance of the licensee in light of the interventions received by the Commission and addressed later in this decision. It also reflects the Commission's concerns regarding the delay in offering service in the area which includes Scott Road and Old Chelsea.
The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, WTVS-TV (PBS), WDIV (NBC), WJBK-TV (CBS) and WXYZ-TV (ABC) Detroit, Michigan, received via satellite from the CANCOM network, as part of the basic service. Consistent with decision CRTC 92-363 dated 18 June 1992, the licensee is also authorized, by condition of licence, to distribute The Sports Network as part of the basic service, so long as it also distributes the French-language specialty service Réseau des Sports as part of the basic service.
An intervention was received from TVOntario objecting to the licensee's distribution of "La Chaîne française", received via satellite. The Commission draws to the licensee's attention that, pursuant to Public Notice CRTC 1986-182 dated 1 August 1986, the distribution of out-of-province educational services not receivable over the air is only authorized subject to the requirement that there be no objection on the part of the originating service. In light of TVOntario's objection, the Commission expects the licensee to cease its distribution of "La Chaîne française".
Moreover, the Commission approves the licensee's request to extend the construction deadline for the area which includes Scott Road and Old Chelsea. Accordingly, it is a condition of licence that construction of the facilities in the area which includes Scott Road and Old Chelsea be completed and that they be in operation on or before 31 March 1993.
In approving this further extension, the Commission took into account the fact that the licensee must wait until Hydro-Québec has replaced the conductors and hydro poles located along Route 105 before it can proceed with construction of the facilities.
The Commission acknowledges the interventions submitted by Lynn Boudreault, Mitch Brisebois and Noreen Browrigg, as well as the complaints filed by subscribers over the course of the present term of licence, wherein dissatisfaction with the quality of the service provided by the licensee is expressed. The Commission also acknowledges the licensee's reply to the interventions and the complaints and expects the licensee to submit, within three months of this decision, a report outlining the steps that it has taken to improve the reception quality of its signal and its service to subscribers.
