Pursuant to Public Notice CRTC 1991-121 dated 22 November 1991, the Commission approves the application to amend the broadcasting licence of the radio programming undertaking CKLW-FM Windsor by adding, pursuant to paragraph 2.2(3) of the Radio Regulations, 1986, (the regulations) the following condition of licence:
 The licensee shall, each broadcast week, devote 12% or more of its musical selections from content category 2 and 10% or more of its musical selections from content category 3 to Canadian selections and schedule those selections in a reasonable manner throughout each broadcast day.
The above condition of licence, in effect, grants the licensee an exemption from the regulatory requirement applicable to most radio stations that at least 30% of the musical selections they broadcast be Canadian. The Commission notes, however, that the minimum Canadian content level of 12% for category 2 music specified in the condition is the same as that contained in the licensee's current Promise of Performance. This level was approved by the Commission in Decision CRTC 87-295 as being consistent with the special approach adopted by the Commission towards the regulation of radio stations in the Windsor market.
At the next licence renewal hearing, the Commission will examine the special competitive situation for commercial broadcasters in the Windsor market and the financial situation of CKLW-FM, with a view to assessing whether or not exemptions to the regulations and elements of the FM policy should continue to be required.
