Following a Public Hearing in the National Capital Region held on 5 March 1991, the Commission renews the Class 1 licence for the cable distribution undertaking serving the communities noted above, held by Rogers Cable TV Limited (Rogers), from 1 October 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
Consistent with Decision CRTC 85-760 dated 12 September 1985 and pursuant to section 12 of the regulations, the licensee is relieved, by condition of licence, of the obligation that it distribute the signal of CHCH-TV Hamilton on an unrestricted channel. Should the quality of the signal deteriorate significantly, the licensee will be expected to undertake immediate corrective action such as moving the service to another channel. Consistent with Decision CRTC 87-279 dated 31 March 1987, by condition of licence, the licensee is relieved of the requirement of section 9 of the regulations to distribute the French-language educational television programming service operated by TVOntario ("La Chaîne Française") on the basic band (channels 2 to 13), so long as it is distributed as part of the basic service.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commision expects the licensee to increase its community programming budget to ensure that, in each year of the new licence term, this budget meets the 5% benchmark level established by the Commission.
Pursuant to paragraph 10(1)(j) of the regulations, the licensee is authorized to continue to distribute, at its option, the programming services of WICU-TV (NBC) and WJET-TV (ABC) Erie, Pennsylvania, received over-the-air, as part of the basic service of the Brantford/ Paris portion of the service area. The Commission notes that the licensee has been distributing these signals on its system for many years.
The Commission notes the numerous interventions received in support of this application.
As a consequence of Decision CRTC 91-8 dated 9 January 1991, which approved of the consolidation of the authorized service territory of the undertaking serving St. Mary's into that of the Kitchener undertaking, no further action is required with respect to the licence renewal application (#902661800) for the St. Mary's system.
