Following a Public Hearing in Vancouver beginning on 12 February 1991, the Commission renews the Class 1 licence for the broadcasting receiving undertaking serving the communities noted above, held by Shaw Cablesystems (B.C.) Ltd., from 1 September 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, KING-TV (NBC), KOMO-TV (ABC), KCTS (PBS), and KIRO-TV (CBS) Seattle, Washington as well as KSTW-TV Tacoma, Washington, received via microwave, as part of the basic service. Further, the licensee is authorized to continue to distribute, at its option, the audio services of KPLU-FM Tacoma and KLSY-FM Bellevue as well as KUBE-FM, KMPS-FM, KUOW-FM, KLTX-FM, KXRX-FM, KNBQ-FM, KING-FM, KEZX-FM, KISW-FM, KSEA-FM and KPLZ-FM Seattle, Washington, received via microwave, on audio channels of the undertaking.

Consistent with Decision CRTC 89-806, the licensee is relieved, by condition of licence, of the requirement of section 12 of the regulations that it distribute the signal of CHEK-TV Victoria on an unrestricted channel. Should the quality of the signal deteriorate significantly, the licensee will be expected to undertake immediate corrective action such as moving the service to another channel.

The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commission encourages the licensee to continue its efforts to develop community programs that reflect subscriber interests and concerns.

In accordance with subsection 22(1) of the Broadcasting Act, the licence will only be renewed at such time as written notification is received from the Department of Communications that it will issue a Broadcasting Certificate.
